Description |
Freedom suits are lawsuits initiated by enslaved people seeking to gain their freedom. These suits are found in both chancery causes and judgments. Predominant documents found in freedom suits include petitions, records of previous court cases, depositions, and affidavits. They record the enslaved person's arguments for freedom, acquisition of enslaved people by enslavers, ancestry of enslaved people, and relationships between enslaved people and enslavers. Enslaved people filed freedom suits based on the following: they were descendant(s) of a free female ancestor, occasionally a Native American; failure of enslaver(s) to abide by the 1778 slave nonimportation act; or claimed to have been freed by ensalver(s) by deed of emancipation or last will and testament. |
